Arvind Kejriwal : Chief Minister Arvind Kejriwal has suffered a major setback in the Delhi Excise Policy case. The Central Bureau of Investigation ( CBI ) has received the necessary approval to file charges against Kejriwal. The court has filed this approval in the Rouse Avenue Court. Let us tell you that the investigating agency has filed a supplementary charge sheet against Kejriwal. The CBI arrested him on 26 June in the alleged corruption case in the Excise case. The Delhi CM is currently in judicial custody. The court is going to consider the supplementary charge sheet on 27 August. Since Kejriwal is the CM, legal approval is necessary before filing charges against him.
CBI has one week
Kejriwal has got bail from ED's arrest in the alleged excise scam case. Earlier on Friday, the Supreme Court postponed the hearing on the petitions of the Aam Aadmi Party convenor. In his petition, Kejriwal has challenged the CBI's arrest. He has also demanded his release. Actually, in this case, the investigating agency demanded time from the court to file a counter affidavit. On this demand, Justice Surya Kant and Justice Ujjwal Bhuvan gave one week to the central investigating agency to file the affidavit.
The hearing will be held on September 5
Senior advocate Abhishek Singhvi, appearing for Kejriwal, said the CBI has filed a counter affidavit on only one petition and it was submitted to him at 8 pm on Thursday. Additional Solicitor General S.V. Raju said he would file a reply in a week. After this, the bench fixed September 5 as the next date of hearing in the case. Kejriwal has filed two separate petitions against the denial of bail to him and his arrest by the CBI in the case. Kejriwal has challenged the August 5 order of the Delhi High Court.
Was asked to go to the lower court for bail
The apex court had on August 14 refused to grant interim bail to Kejriwal in the case and sought the probe agency's response to a plea challenging his arrest. The Delhi High Court had on August 5 upheld Chief Minister Arvind Kejriwal's arrest and said there was no malice in the CBI's actions. The court had said that the CBI had been able to prove how Kejriwal, the national convener of the Aam Aadmi Party (AAP), could influence witnesses who had mustered the courage to testify only after the chief minister's arrest. The high court had asked him to approach the trial court for regular bail in the CBI case.
Arrested by ED on 21 March
The High Court had dismissed Kejriwal's plea challenging his arrest and said that the agency would start further investigation against him only after sufficient evidence was collected and approval was granted in April 2024. The court had said that the strings of crime extend to Punjab, but important witnesses were not coming forward due to the influence of Kejriwal's position. The judge had said that the witnesses came forward to record their statements only after his arrest. Kejriwal was arrested by the Enforcement Directorate (ED) on March 21 and was granted bail by the lower court on June 20 in the money laundering case. The High Court, however, stayed the lower court's order. The Supreme Court had granted him interim bail in the money laundering case on July 12.
