Supreme Court Hearing Over RG Kar Case : The Supreme Court on Thursday refused to transfer the trial of the rape and murder of a trainee doctor in Kolkata out of West Bengal. A bench headed by Chief Justice DY Chandrachud said that the trial court judge has enough powers to order a second inquiry if he feels necessary after examining the evidence. The apex court also examined the sixth status report filed by the CBI in connection with the rape and murder case at Kolkata's RG Kar Medical College and Hospital, but refrained from making any comment, saying that the investigation is ongoing.

The hearing will be held after four weeks.

The apex court said that a Kolkata court had framed charges against prime accused Sanjoy Roy on November 4 and the daily hearing in the case would begin from November 11. During the hearing, the National Task Force (NTF) constituted to formulate a protocol for the safety of healthcare professionals and submitted its report to the apex court. The apex court directed the NTF report to be shared with all states and union territories and posted the hearing for four weeks later.

On October 15, the top court questioned the West Bengal government on the appointment of civic volunteers in the state and sought data on their recruitment and appointment process. On September 30, the top court expressed dissatisfaction over the state's "slow" progress in installing CCTVs and construction of toilets besides separate restrooms in government medical colleges and ordered it to be completed by October 15.

Dissatisfaction was expressed in the status report of CBI.

On September 17, the apex court had expressed displeasure over the findings of the CBI's status report in the case and refused to give details, saying any disclosure could jeopardize the ongoing investigation. During the hearing, the CJI said that we have seen the sixth status report filed by the CBI, in which the lower court has framed charges against the accused under sections 64 and 103 of the BNSS. The next hearing is on November 11. Since the investigation is going on, we are not commenting on it. CBI should file a status report after 4 weeks.

The report of the National Task Force has been filed by the Central Government. The Central Government's lawyer said that the entire report includes short-term, long-term, and medium-term measures. It is divided into three parts. The CJI said that the National Task Force (NTF) has submitted a report. The NTF has prepared its recommendations for preventing violence against medical professionals and creating a safe workplace.

The other recommendations are for the prevention of sexual violence against medical professionals. NTF has said that all states and high Courts should follow the report. Therefore, we direct that a copy of the report be made available to all lawyers, Chief Secretaries of all states, Union Territories and if the states want to make some more recommendations in it, then inform the court within three weeks.
